Terms of Service

Important: These Terms of Service ("Terms") govern your use of BSP Solutions LLC's Applied Behavior Analysis (ABA) therapy services. By engaging our services, you agree to be bound by these Terms. Please read them carefully.
1. Acceptance of Terms
By enrolling in BSP Solutions' services, scheduling a consultation, or allowing your child to receive our services, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service and our Privacy Policy.
2. Services Provided
2.1 Scope of Services
BSP Solutions provides premium Applied Behavior Analysis (ABA) therapy services through a membership model, including:
- Board Certified Behavior Analyst (BCBA) supervision and program development
- Registered Behavior Technician (RBT) direct therapy services
- Comprehensive behavioral assessments and intervention planning
- Parent training and family support services
- Care coordination with educational and medical teams
- Progress monitoring and reporting
2.2 Membership Tiers
We offer three membership levels: Foundational, Signature, and Premier. Each tier includes different levels of service intensity, support hours, and access to our clinical team. Specific details of your selected membership will be outlined in your Membership Agreement.
3. Eligibility
Our services are designed for children ages 2-12 with autism spectrum disorder (ASD) or related developmental conditions. Acceptance into our program is subject to:
- Clinical appropriateness as determined by our Clinical Director
- Availability of appropriate clinical staff
- Geographic service area limitations
- Family's ability to meet membership requirements
4. Financial Terms
4.1 Membership Fees
- Membership fees are established during your consultation and detailed in your Membership Agreement
- Fees are due on the 1st of each month in advance
- We accept ACH transfers, wire transfers, and major credit cards
- All payments are processed through secure, PCI-compliant systems
4.2 Late Payments
- Payments are considered late after a 5-day grace period
- Late payments incur a 1.5% monthly fee
- Services may be suspended for accounts more than 30 days past due
4.3 Refund Policy
Membership fees are non-refundable except as required by law. Unused services do not carry over to subsequent months.
5. Service Delivery
5.1 Scheduling
- Services are scheduled based on clinical recommendations and family availability
- We strive to maintain consistent scheduling but cannot guarantee specific time slots
- Schedule changes require 48-hour notice when possible
5.2 Cancellations
- 24-hour notice is required for session cancellations
- Late cancellations may result in forfeiture of that session
- Excessive cancellations may result in membership review
- We maintain flexibility for documented emergencies
5.3 Service Location
Services may be provided in your home, our clinical facilities, or other agreed-upon locations. You are responsible for providing a safe, appropriate environment for therapy sessions.
6. Parent/Guardian Responsibilities
As the parent or legal guardian, you agree to:
- Provide accurate and complete information about your child
- Maintain a safe, distraction-free environment for therapy
- Ensure an authorized adult is present during all sessions
- Participate in parent training sessions as recommended
- Communicate openly with our clinical team
- Follow through with recommended strategies between sessions
- Notify us immediately of any changes in your child's health or medications
7. Professional Boundaries
To maintain professional therapeutic relationships:
- Our staff may not accept gifts exceeding $25 in value
- Personal relationships between staff and families are prohibited
- Staff may not provide services outside of BSP Solutions
- Social media connections between staff and families are not permitted
- Staff may not provide childcare or other non-therapeutic services
8. Confidentiality and Privacy
We are committed to protecting your family's privacy in accordance with HIPAA and applicable state laws. Please refer to our Privacy Policy for detailed information about how we collect, use, and protect your information.
9. Consent for Treatment
By enrolling in our services, you consent to:
- ABA therapy services for your child
- Collection of behavioral data and progress monitoring
- Communication between our clinical team members
- Use of evidence-based behavioral interventions
10. Limitation of Liability
While BSP Solutions maintains comprehensive insurance and strives for exceptional outcomes, we cannot guarantee specific results. ABA therapy effectiveness varies by individual. Our liability for any claim arising from our services is limited to the amount of fees paid in the three months preceding the claim.
11. Termination
11.1 Voluntary Termination
Either party may terminate services with 30 days written notice. Upon termination, we will provide transition planning and necessary documentation.
11.2 Immediate Termination
BSP Solutions reserves the right to terminate services immediately for:
- Non-payment of fees
- Threats or violence toward staff
- Failure to maintain a safe therapy environment
- Repeated violation of these Terms
- Behavior that compromises clinical integrity
12. Dispute Resolution
We are committed to resolving any concerns promptly and fairly. In the event of a dispute:
- First, contact our Clinical Director to attempt informal resolution
- If unresolved, submit a written complaint to our Executive Director
- If still unresolved, the matter will be submitted to binding arbitration in Clark County, Nevada
13. Governing Law
These Terms are governed by the laws of the State of Nevada. Any legal action must be brought in the courts of Clark County, Nevada.
14. Modifications to Terms
BSP Solutions may modify these Terms with 60 days notice to members. Continued use of our services after modification constitutes acceptance of the updated Terms.
15. Entire Agreement
These Terms, together with your Membership Agreement and our Privacy Policy, constitute the entire agreement between you and BSP Solutions.
